1. INTRODUCTION

Welcome to Commercestar Engineering Pte Ltd (“Commercestar”, “We”, “Us”, “Our”). These Terms of Service (“Terms”) govern your purchase, installation, and use of air-conditioning systems, related products, and installation services (“Products”, “Services”) offered on our Shopify store and other sales channels.

By placing an order with us, you agree to be bound by these Terms.

2. DEFINITIONS

“Purchaser” means the original end-user customer who purchases Products or Services from Commercestar.

“Product” means air-conditioning units, components, and accessories supplied by Commercestar.

“Service” means installation services, site surveys, and related workmanship provided by Commercestar.

3. ORDER FORMATION & ACCEPTANCE

3.1 All orders placed through the Commercestar Shopify store are subject to acceptance by Commercestar. We reserve the right to refuse or cancel any order for any reason, including inventory, errors, or suspected fraud.

3.2 Ownership of Products passes to the Purchaser only upon receipt of full payment and completion of installation (if applicable).

4. SITE SURVEY & INSTALLATION ARRANGEMENTS

4.1 All installation orders include a complimentary site survey to assess installation feasibility, materials, and any additional charges.

4.2 After order confirmation, Commercestar will contact the Purchaser within 1 working day to arrange a site survey and installation date.

4.3 The Purchaser or authorized representative must be present during site survey and installation to confirm unit locations and routing.

4.4 Any changes requested after these confirmations may incur additional charges.

5. DELIVERY & ACCESS

5.1 Delivery and installation scheduling depends on site availability, material supply, and survey results.

5.2 Purchaser must provide safe and reasonable access to the installation site. Commercestar may refuse or postpone installation if access is unsafe or insufficient.

5.3 For installations above 3.5m or requiring specialized access (e.g., lift platform), additional charges will apply.

6. INSTALLATION MATERIALS

Unless otherwise expressly stated in the selected package, installations use the following standard materials:

✔ 21 SWG copper piping (0.81mm) – USA origin

✔ ½" K-Flex Titan Class “0” insulation (no joints ≤15m)

✔ Litaflex UPVC trunking and drain pipe

✔ Sigma / Keystone electrical components

✔ Singapore-made wiring cables

Additional materials, upgrades, and non-standard components may incur separate charges.

7. ADDITIONAL CHARGES

Additional charges may apply for:

• Extra piping length beyond standard package limits
  
• Trunking modifications
  
• Powerpoint / isolator installation
  
• Ceiling patching and repainting
  
• Condenser brackets or water trays
  
• Second-trip installation
  
• High-level / head-height work
  

All additional charges will be communicated to the Purchaser before work proceeds.

8. PRICING & PAYMENT

8.1 All prices are stated in Singapore Dollars (SGD) and exclude any applicable taxes or fees unless expressly stated.

8.2 Payment terms are as specified on the order invoice. Full payment may be required before installation commencement.

8.3 Failure to pay may result in cancellation of order or withholding of Services.

9. WARRANTY & AFTER-SALES

9.1 Commercestar provides warranty coverage as outlined in our Warranty Policy. Warranty terms may vary by Product and installation type.

9.2 Workmanship warranty applies only where installation is carried out by Commercestar or its authorized representatives.

9.3 Warranty does not cover defects arising from misuse, lack of maintenance, unauthorized modifications, natural wear and tear, or external environmental conditions.

9.4 Any manufacturer warranty claims are subject to the respective manufacturer’s terms.

10. LIMITATION OF LIABILITY

10.1 To the fullest extent permitted by law, Commercestar and its affiliates will not be responsible for any indirect, incidental, consequential, special, or punitive damages arising from the use, inability to use, or performance of any Products or Services.

10.2 This includes, but is not limited to: loss of revenue, loss of data, loss of business opportunity, or damage to other property.

10.3 Commercestar’s maximum liability shall not exceed the purchase price paid for the specific Product or Service that gave rise to the claim.

11. RETURNS & REFUNDS

11.1 Once installation has commenced or been completed, no refunds or cancellations are permitted for installed Products or Services.

11.2 Returns for non-installed Products (e.g., replacements) may be accepted only under prior written approval by Commercestar and subject to inspection.

11.3 Restocking or handling fees may apply.

12. FORCE MAJEURE

Commercestar shall not be liable for failure or delay in performing obligations due to events beyond its reasonable control, including but not limited to pandemics, natural disasters, supply chain disruptions, or governmental actions.

13. PRIVACY & DATA

Any personal information collected during the purchase, installation, or warranty process will be handled in accordance with our Privacy Policy.

14. GOVERNING LAW & JURISDICTION

These Terms of Service shall be governed by and construed in accordance with the laws of Singapore. Any dispute shall be subject to the exclusive jurisdiction of the courts of Singapore.

15. AMENDMENTS

Commercestar reserves the right to revise these Terms at any time without prior notice. The updated Terms shall apply to all future orders from the date of publication.
